1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Fetch SMS website, dashboard, and API (collectively, the "Service"), operated by Fetch SMS ("we", "us", or "our"). By creating an account, making a purchase, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Modification of Terms

We reserve the right to modify, amend, or replace these Terms at any time, in our sole discretion. Changes are effective when posted on this page with an updated date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

4. Description of Service

Fetch SMS provides access to non-VOIP US phone numbers for the purpose of receiving SMS verification codes, offered as short-term verifications (a single code within a fixed window) and longer-term rentals (a number reserved for a chosen period). We do not control whether any third-party platform accepts a given number, and we do not guarantee that any particular code will be received.

5. Acceptable Use; Prohibited and Illegal Activities

You agree not to use the Service for any unlawful, fraudulent, or abusive purpose. Prohibited activities include, without limitation:

  • Fraud, identity theft, impersonation, phishing, or any deceptive practice;
  • Harassment, spam, or sending unsolicited or bulk messages;
  • Creating accounts or evading bans in violation of a third party's terms of service;
  • Circumventing the security, authentication, or anti-fraud measures of any platform;
  • Any activity that violates applicable local, state, national, or international law or regulation; and
  • Any activity that infringes the rights of, or causes harm to, any person or entity.

6. Your Responsibility

You are solely and fully responsible for all activity conducted using the phone numbers and codes you obtain through the Service, and for ensuring that your use complies with all applicable laws and third-party terms. We do not authorize, condone, or knowingly facilitate any illegal activity. We may monitor the Service for prohibited and illegal activity and reserve the right to investigate suspected violations, suspend or terminate your account, withhold or reverse transactions, and cooperate with law enforcement and report unlawful conduct. You agree to indemnify and hold us harmless from any claims, losses, or damages arising out of your use of the Service or your violation of these Terms.

7. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and API keys and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

8. Purchases, Payment, and No-Refund Policy

Prices are stated in US dollars and charged from your prepaid wallet balance, which you fund by card or cryptocurrency. All purchases and wallet deposits are final and non-refundable. By making a purchase or deposit, you acknowledge and agree that you are not entitled to any refund, chargeback, or return, and that wallet balances are not redeemable for cash. As a courtesy and as the sole remedy where a short-term verification does not receive a code within its delivery window, the amount charged for that verification is automatically credited back to your Fetch SMS wallet; this wallet credit is not a cash refund. You agree to this no-refund policy at the time of purchase.

9. Delivery

The Service is a digital service delivered electronically. Numbers are provisioned to your account instantly upon purchase, and verification codes are delivered to your dashboard and via the API in real time as they arrive. No physical goods are shipped.

10. Availability and Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that any number will be accepted by a given platform, or that any code will be received.

11. Limitation of Liability

To the maximum extent permitted by law, Fetch SMS and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us for the specific transaction giving rise to the claim.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including a violation of these Terms. Upon termination, your right to use the Service ceases immediately.
